When you are investigating the cause of motor vehicle accidents, did the accident happen in rainy weather?
The storm water drainage system is not being maintained very well, at least in Mobile. Here is a photo of a drainage inlet on a Telegraph Road. The structure is not only damaged, but the interior of the inlet is clogged with trash and concrete debris. Not only that, ignoring obvious trash like this in the storm water inlet contributes to the pollution of state waters in violation of the federal Clean Water Act. That alone is an offense that the City should be sued for.
Inlets clogged with trash, dirt and debris do not allow rain water to drain as quickly as it would if the inlet was maintained and not clogged. Clogged inlets can lead to street flooding. Flooded streets can lead cars and trucks hydroplaning on the water. Hydroplaning can cause loss of control of the vehicle leading to an accident.
So, if a driver involved in a wreck said they lost control of their vehicle when the streets were wet from rain, investigate the condition of the nearby storm water inlets.
If any of the nearby inlets are obviously clogged with trash, dirt or debris, sue the hell out of who ever is responsible for keeping the MS4 (storm water drainage system) functional.
Perhaps the throat of the inlet is clogged with a specific product, like a bunch of 2-liter Coke bottles. Sue the hell out of Coke. Maybe the inlet is partly clogged with pine tree bark chips like an inlet on Conception Street Road is. Sue the hell out of the nearby company producing the bark chips, the company hauling the bark chips leaving the roadside littered with bark chips, and be sure to sue the city responsible for maintaining the inlet for failing to keep it functional.
There seems to be a large amount of neglect of the crippled storm water system in Mobile. Drivers, if you lose control of your vehicle due to water on roads, check the nearby inlets for clogging. If clogged, sue the hell out of the City and any other companies that are complicit in clogging the drainage inlet.
The irresponsible City of Mobile continues to waste millions of taxpayer money on facilities that lose money every year. The City seems to have millions to spend on parks and recreation including new soccer fields for the County. Why, building and maintaining museums seem to be more important than keeping the storm water system in good working order.
Meantime anyone traveling along roads in Mobile can see a lot of drainage inlets completely filled with dirt. Ironically I see dump trucks going down the road all the time dropping dirt on the road because the load is not covered or the dirt spilled on the external outside part of the truck during loading wasn't removed before the truck left the dirt pit.
There needs to be a whole lot of suing going on to stop the destruction of the functionality of Mobile's (MS4) storm water drainage system and to get the current storm water drainage system completely unclogged.
But then again, maybe lawyers want the City's storm water system to remain partially clogged because it can lead to more accidents... Based on the amount of advertising on TV by lawyers seeking accident victims, accidents must be a lucrative business.
